Information on the processing of personal data in applicant management

Privacy policy for applicants of ALTHOM GmbH

With the following information, we would like to give you an overview of the processing of your personal data as an applicant for a job offer or in the context of an unsolicited application.

I. Who is responsible for data processing in the application procedure?

The responsible company for data processing is the ALTHOM Group company with which you make direct contact. When we contact you, you will find the name and contact details of the ALTHOM Group company responsible, for example, on the letterhead or in the signature line of an e-mail.  These are:

II. What data do we process as part of the application process?

In the application process, we only process the personal data that you send us with your application. As a rule, this is the following data:

Surname, first name and date of birth; contact data (telephone number, e-mail address); nationality; the log data generated when using the IT systems as well as other application data such as curriculum vitae, cover letter and certificates; if applicable, information on state of health or severe disability; if applicable, an application photo; account data in the event of reimbursement of travel expenses; if applicable, other information that you provide during the interview.

III. for what purposes and with what legal basis is the data processed?

We process the data you provide for the purpose of reviewing your application and your suitability for the advertised position as well as for carrying out the application process. The legal basis in this respect is § 26 BDSG. In addition, it may be necessary to process your data for the defense or enforcement of legal claims. This purpose is also our legitimate interest. The legal basis for this processing is Art. 6 para. 1 p. 1 lit. f DSGVO.

If your application documents contain special categories of personal data in accordance with Art. 9 (1) DSGVO, we will process this data as part of the application process in order to exercise rights or fulfill obligations arising from labor law, social security law and social protection. The legal basis in this respect is Art. 6 para. 1 sentence 1 lit. c DSGVO in conjunction with. Art. 9 para. 2 lit. b DSGVO and Section 26 para. 3 BDSG.

On the other hand, we only process personal data to the extent that this is permissibly

  • Received from third parties (e.g. recruiters) or
  • obtained from publicly accessible sources (e.g. professional social networks or search engines).

IV. When do we delete your data?

Your data will be deleted no later than 6 months after the end of the application process for the position for which you have applied, unless we have hired you. If we have concluded an employment contract with you, your application data will be included in the personnel file. 

If you have given us your consent to continue storing your application data in our applicant database, we will process your data for the selection of suitable employment options for you, subject to your revocation of this consent. The legal basis for this is Section 26 (2) BDSG in conjunction with your consent.

V. To which recipients will your data be passed on?

Your applicant data will only be passed on to those departments or persons in the company who need it to carry out the application process and to check the applicants.

After consultation and with your consent, we may also pass on your personal data to our customers for the purpose of initiating an employment relationship in order to check a possible assignment there. As a rule, this is done in anonymized or pseudonymized form, so that it is not possible for these customers to identify the applicant presented. If a customer requests that data be passed on in a non-anonymized or pseudonymized form, we will only comply with this request if you have given your consent to this after being informed in advance.

No data is transferred to a third country or to international organizations.

VI. Your data subject rights

As a data subject, you have the following rights. If you wish to make use of these rights:

  • You have the right to obtain information about the processing of data concerning you from the controller.
  • You have the right to rectification or deletion of your personal data or to restriction of processing.
  • If processing is based on a legitimate interest, you may object at any time on grounds relating to your particular situation.
  • You have the right to data portability of the data you provide.
  • In the case of consent, you have the right to revoke it at any time. Until the revocation, the lawfulness of the processing based on the consent remains unaffected.

VII. Right of appeal to a supervisory authority

If you believe that the processing of your personal data violates data protection law, you have the right to lodge a complaint with a data protection supervisory authority pursuant to Art. 77 (1) DSGVO.
